Terms of Service
Effective date: March 30, 2026
1. Acceptance of Terms
By creating an account or using the KeepsakeVault mobile application or website (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service. You must be at least 16 years old to create an account.
2. Description of Service
KeepsakeVault is a private family memory preservation service. It allows registered users to capture, store, and share memories — including text, photos, videos, and audio recordings — within a private family vault. Features include:
- Memory Feed: a chronological record of moments for each child profile.
- Sealed Letters: time-locked messages revealed on a chosen future date.
- Family Sharing: invite co-parents, grandparents, or other trusted family members to view and contribute memories.
- Vault Handoff: transfer a child's complete memory archive to them when they come of age.
- Series and Milestones: organize memories into themed collections.
3. Accounts
You are responsible for maintaining the confidentiality of your account credentials. You agree to notify us immediately of any unauthorized use of your account. We are not liable for losses caused by unauthorized account access that results from your failure to safeguard your credentials.
You may not create an account on behalf of another person without their authorization, or create multiple accounts for abusive purposes.
4. Subscriptions and Billing
Plans
KeepsakeVault offers three plans:
- Free — 512 MB storage, text and photo memories only.
- Keeper — 50 GB storage, video and audio memories; monthly and annual options are shown at checkout.
- Family Vault — 200 GB storage and all Keeper features; monthly and annual options are shown at checkout.
Billing
Web subscriptions may be billed monthly or annually in advance through Stripe, as shown at checkout. Mobile subscriptions may be billed monthly or annually through Apple App Store or Google Play and are managed in the app through RevenueCat. Storage overages (usage beyond your plan's included storage) are billed monthly as a metered add-on at the end of each billing period. Prices, taxes, and renewal terms are shown by the applicable checkout or store.
Cancellation and refunds
For a web subscription, use the Stripe billing portal from Account to cancel. For a mobile subscription, use the Apple App Store or Google Play subscription settings. Cancellation normally takes effect at the end of the current billing period; access and refunds are subject to the applicable provider's terms. We do not offer prorated refunds for unused subscription time except where required by law.
Free tier limits
If your account is downgraded to the Free tier and your existing content exceeds the Free tier storage limit, your memories will remain accessible but you will not be able to upload new media until your storage is within the Free tier limit.
5. Your Content
You retain full ownership of all memories, photos, videos, audio recordings, and other content you upload to KeepsakeVault ("Your Content"). By uploading content, you grant us a limited, non-exclusive, royalty-free license to store, process, and display Your Content solely to provide the Service to you and your vault members.
We do not claim ownership of Your Content and we do not use it for advertising or AI training purposes.
You are responsible for ensuring You have the right to upload and share any content you add to KeepsakeVault. Do not upload content that infringes on the intellectual property rights of others.
6. Acceptable Use and Content Policy
KeepsakeVault is a private family service. You agree not to upload, share, or store content that:
- Is illegal, including child sexual abuse material (CSAM) — any such content will be immediately reported to the National Center for Missing and Exploited Children (NCMEC) and law enforcement.
- Is threatening, harassing, or abusive toward any person.
- Constitutes spam or commercial solicitation.
- Contains malware, viruses, or malicious code.
- Violates the privacy rights of others, including non-consenting individuals.
- Infringes any patent, trademark, trade secret, copyright, or other intellectual property right.
We reserve the right to remove content that violates these Terms and to suspend or terminate accounts engaged in repeated or severe violations.
Reporting. If you encounter content within a shared vault that you believe violates these Terms, use the "Report" button on the memory to notify us. We review all reports and take appropriate action.
7. Vault Sharing and Permissions
When you invite another person to your vault, they can view non-private memories and, depending on the permissions you grant, add their own memories. You are responsible for who you invite. Vault owners can remove members at any time.
Private memories (marked as private by the author) are visible only to the original author.
8. Vault Handoff
The Vault Handoff feature lets you designate a future recipient (typically the child themselves when they come of age) to receive a child's complete memory archive. Once a handoff is claimed by the recipient, ownership of that child's memory archive transfers to them. This action is irreversible. Please use this feature deliberately.
9. Service Availability
We aim to provide a reliable service but do not guarantee uninterrupted access. We may perform maintenance, apply updates, or experience outages. We will make reasonable efforts to give advance notice of planned downtime.
We strongly encourage you to use the in-app Export feature to keep your own backup copies of your memories.
10. Termination
You may request account deletion from Settings or the Delete Account page. A request locks the account and starts a 30-day recovery window. After that recovery window, the account becomes eligible for final deletion processing and is surfaced by a daily job; final deletion may require operational processing before the app account, vault data, and uploaded media are removed. We may suspend or terminate your account if you violate these Terms, fail to pay fees owed, or if we decide to discontinue the Service (with reasonable notice).
Account deletion does not erase billing or transaction records held by Stripe, Apple App Store and Google Play, or RevenueCat where those providers must retain them under their policies or applicable law. Provisions that by their nature should survive termination (including Sections 5, 6, 11, and 12) will survive.
11. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE ERROR-FREE, SECURE, OR CONTINUOUSLY AVAILABLE.
12. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, KEEPSAKEVAULT AND ITS OFFICERS, DIRECTORS, AND EMPLOYEES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING FROM OR RELATED TO THESE TERMS OR THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM AROSE, OR (B) $100 USD.
13. Governing Law
These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles. Any dispute arising from these Terms will be resolved exclusively in the state or federal courts located in Delaware.
14. Changes to These Terms
We may update these Terms from time to time. For material changes, we will provide at least 14 days' notice by email or in-app notification before the new Terms take effect. Your continued use of the Service after that date constitutes acceptance.
